AGREEMENT FOR VOLUNTARY PAYMENT IN LIEU OF TAXES (PILOT)

PUBLIC SAFETY SERVICES FEE & ANNUAL CONTRIBUTION

Between the City of Orange and Chapman University

KEY DEAL POINTS

Area of Interest – Description COO 1. Agreement to be named “PUBLIC SAFETY SERVICES FEE & ANNUAL

CONTRIBUTION”

2. Funding will be specifically designated for City of Orange Public

Safety Services and distributed at the sole discretion of the Orange

City Council

3. Initial Term Shall be for five (5) years

4. Commencement of Agreement shall be on August 1, 2026

5. Fees under this agreement shall be based on FTE Student

population at the Orange Campus Only.

6. Annual fees will be calculated and paid on a specified date on or

near the beginning of each academic year while this Agreement is

in place.

7. Year One (1) fees under this Agreement shall be $50.00 per FTE

student enrolled at the City of Orange campus.

8. Year Two (2) fees under this Agreement shall be $100.00 per FTE

student enrolled at the City of Orange campus.

9. Year Three (3) and all subsequent years under this Agreement shall

be $150.00 per FTE student enrolled at the City of Orange campus.

10. Public Safety PILOT Agreement shall end in June 2031 unless both

parties agree to an extension of this Agreement and/or negotiate a

new Agreement.

CU11. 12. 13. 14. 15. 16. City of Orange shall provide an annual public accounting of how

Public Safety PILOT fees are distributed to its public safety services.

No penalties or sanctions shall be levied above and beyond fee

schedule outlined in this Agreement should the University’s

enrollment exceed less than 10% of current allowable limits.

Should enrollment exceed more than 10% of current allowable

limits, the fees outlined in this Agreement shall double for each FTE

student enrolled above the 10% enrollment cap.

The City of Orange shall make an annual Goodwill Statement at a

public meeting of its choosing to publicize the annual contribution,

publicly acknowledge the partnership between itself and University

leadership, and, as appropriate, acknowledge other relevant

partnership information.

This statement shall also be printed and/or published on the City’s

website, social media channels, and its email or quarterly magazine

communications.

The City shall also publish, or to be published, an annual press

release for distribution to local media and reporters.

The City agrees to the placement of a city entry ‘Monument Sign’

to be designed, produced/fabricated, and installed at Chapman

University’s sole expense, stating that the City is ‘Home to

Chapman University’.

The sign shall replace the current city entry sign located on Glassell

Street at the SR-22/Hart Park entrance crossing, facing the City of

Santa Ana.

Design and fabrication will be in accordance with all current

Historic District Standards and subject to the review and approval

of the Orange City Council.

Chapman University agrees to modify certain events that take place

throughout the academic year that currently utilize commercial

grade fireworks displays at Wilson Field in Old Towne Orange.17. 18. In lieu of any pyrotechnic displays, the University agrees to institute

drone-only, or light shows to create a better quality of life for

adjacent residents.

Chapman University agrees to pay a negotiated rate in lieu of

parking enforcement during large-scale events, specifically the

University’s annual Commencement Ceremonies.

Chapman University shall work with the City of Orange to

cooperatively facilitate a dissolution of the student-led ‘Undie Run’

as a matter of public safety and in the interest of individual student

welfare.

Should the parties be unsuccessful in facilitating an end to this bi-

annual event, Chapman University agrees to support the City in

citing participating students and/or holding student leaders

accountable for not following prescribed regulations, permitting,

and liability coverage all other residents must adhere to.
